Who's responsible for handling your data?

Who actually handles the requests you send?
[email protected] and [email protected] land in the same inbox, which Denys Fomichov reads and answers. Denys Fomichov handles this data under the authority and direct instructions of the controller, Hlib Fomichov (GDPR art. 29) — he is not an independent controller and not a third party your data is disclosed to.
What data do we collect, and why?
Submitting the contact form on fomia.ai collects three things, all required: the name you give us, your website address, and the contact detail you list (email or phone). We use this only to answer your review or quote request. Without these three items, we can't respond to your request. The form doesn't collect any other personal data — no health information, no financial information, nothing else.
This site doesn't run analytics or advertising, so we don't collect browsing data tied to your identity beyond what's described in "Who do we share your data with?" below (the technical processing Cloudflare does to serve the page).
What's the legal basis for this?
The legal basis is your consent (GDPR art. 6(1)(a)), which you give by checking the required box on the form before submitting it. You can withdraw your consent at any time by writing to [email protected], without affecting the lawfulness of what we did with your data before you withdrew it.
Who do we share your data with?
Your data is emailed through Zoho Mail, which runs on an EU data center, acting as our processor for sending and storing that email. fomia.ai is hosted by Cloudflare, which technically processes requests to the site (including your IP address at the network level, solely to serve the page and limit abuse) as our processor.
We don't share your data with anyone else, don't sell it, and don't use it for advertising.
Do we transfer your data outside the EU?
- Cloudflare: yes, this involves a transfer to the United States, covered by the EU Standard Contractual Clauses and/or the EU-US Data Privacy Framework, depending on whichever safeguards Cloudflare has in place at any given time (Articles 45 and 46 GDPR).
- Zoho: your data is hosted on Zoho's EU data center. If a provider ever needed to access it from outside the European Economic Area, that transfer must rely on the safeguards of Articles 45–46 GDPR (an adequacy decision or standard contractual clauses).
- WhatsApp: if you choose to contact us through the WhatsApp link on this site, that exchange is covered by WhatsApp Ireland Limited's privacy policy, which can involve data transfers within the Meta group, including to the United States.
How long do we keep your data?
Requests received in our contact inbox are kept for 12 months from our last exchange with you — whichever of us wrote the most recent message. After that, we remove them from our inbox; this isn't an automated process. The technical log of the form submission (which doesn't include your details or your IP address) is kept for no more than 30 days.
Does Fomia build automated profiles from your data?
No. Fomia doesn't make automated decisions or build profiles from the data you give us.
What are your rights, and how do you exercise them?
You can exercise your rights to access, correction, deletion, objection, restriction of processing, portability, and withdrawal of consent at any time by writing to [email protected] and identifying yourself. You can also file a complaint with the Spanish data protection authority (AEPD, aepd.es) — or with the supervisory authority in your own EU country — if you believe we haven't handled your data properly.
For US residents
We are based in the EU and our processing is governed by GDPR, as described above. We're not making a claim about whether US state privacy laws like the CCPA apply to us. Regardless, here's what we actually do: we don't sell your personal information, we don't "share" it for cross-context behavioral advertising, and we don't use it for targeted advertising. If you have a request about your data, write to [email protected] and we'll handle it the same way we handle any other privacy request on this page.
